SoundSplore Intellectual Property Policy

SoundSplore Inc., (“SoundSplore”, “we”, “us”, “our”) respects the intellectual property rights of others. We also expect that users of our platform respect the intellectual property rights of others.

Ensuring that artists and rightsholders have the tools they need to protect their work is very important to SoundSplore.. If you are the holder of a copyright and believe in good faith that your work has been reproduced on our platform in a way that constitutes copyright infringement, please email support@soundsplore.com to notify SoundSplore.

Reports of Infringement

We are required by copyright law to take down content that are reported to us for infringement. We are also required by copyright law to have a repeat infringement policy.

To report a claim to support@soundsplore.com, please include:

1. Specific identification of each copyrighted work claimed to have been infringed;

2. Where the material is located on SoundSplore that is claimed to be infringing;

3. Contact information for the complaining party including name, address, telephone number and email address;

4. A statement that the complaining party has good faith belief that use of the work(s) in the manner complained is not authorized by the copyright owner, its agent, or the law; and

5. A statement that the information is accurate, and under the penalty of perjury, the complaining party is the owner of the allegedly infringed, or agent for the owner.

6. A signature of the owner (or person authorized to act on behalf of the owner) of the copyright that is allegedly infringed.

When you submit a copyright claim, we may pass information to the alleged infringing party and retain your information as long as required for legal purposes. Fraudulent reports or other misuse of this process may result in termination of your account and/or legal consequences.

We will evaluate the claim and take appropriate action, which may include removing the reported content. The law requires SoundSplore to act quickly in removing content that is claimed to be infringing. If you believe your content has been mistakenly actioned, or you would like to request another review of the decision on your claim, you may have an opportunity to submit an appeal. The email correspondence we will send you regarding the claim will contain instructions on how to appeal.

SoundSplore has a repeat infringer policy, meaning users or creators with multiple violations may have their account terminated. If one of your tracks is reported and you believe an error has been made, please file an appeal and provide as much detail as possible. If content is reinstated following an appeal, our repeat infringer policy will reflect that accordingly. SoundSplore will not be reviewing contracts and other documents as a way to mediate a dispute as to copyright ownership, which should be resolved in a court of law.

2. Handling Blocked Content:

- If an artist's own upload is blocked due to matching content they created, they must provide confirmation of their digital distribution rights from the distributor to reinstate the blocked content.

- Users can file a dispute to address any misidentification issues, providing detailed information for review by our Copyright Team.

3. Manual Reports of Infringement:

- We promptly take down tracks reported for infringement as required by copyright law.

- Users receive a "strike" for reported infringing content; accounts with more than two strikes are permanently terminated.

- Users can file a dispute if they believe an error occurred, but we do not mediate disputes over copyright ownership.

4. Leaking Unreleased Content:

- We have a zero tolerance policy for the unauthorized publication of unreleased content.

- Accounts reported for sharing unreleased, copyright-protected content are immediately suspended or terminated.

5. Copyright and Trademark Policies:

- Users must comply with all applicable laws, rules, and regulations, respecting the intellectual property rights of others.

- Copyright and trademark holders can submit notices of infringement, providing specific details as outlined in our policy.

- We may terminate accounts of repeat infringers and retain user information for legal purposes.

6. Handling Claims:

- We review and evaluate all claims received through designated channels, taking appropriate action, which may include removing reported content or disabling access.

- Communication may occur between the claimant and the user or creator regarding the actions taken or for further information.

- Content reinstated following appeals or retracting claims will be reflected in our repeat infringer policy accordingly.

- We employ a combination of automated and manual signals to detect and remove infringing content continuously.

This policy emphasizes the importance of respecting intellectual property rights while providing avenues for dispute resolution and appeals. It ensures compliance with copyright law and maintains a balance between protecting creators' rights and the interests of users.
